Is it against the law to fish in the barge turn around area?

Kyle Kennington

Was told by LDWF that they can issue you a ticket if you are caught or reported in there. It's been at the forefront of a controversary since they opened it up and that's why it's off limits to most tournaments. Right now they are power driving posts in the back corner. Looks like they may be getting ready to use it again. Last time I fished in there...the security guard at the port asked us to leave.

It's private property, property of the Port, and fishing on private property (according to Louisiana law) is trespassing.

my 2 cents....if it's restricted acces by the state/parish..signage must be obvious and readable...for the law to ticket...however: SRA had an issue like this by the dam..at Toledo  Bend...research station...Now there are sign out and obvious..STAY OUT...

I still do not understand how water can be posted...

ronalddipietro

I think its more like:..when it floods real high, any public can access most anywhere, even you back yard...because the water is not you property..so its ok to be there, but, when water is adjacent to an entrance, building piers, banks roped off, etc..then the the authorty of the waterr has the ritgts...Whew..its early..need more coffee

I don't think it is the water that is posted as much as the right of way.  It has to do with eminent domain of a government body and that of public safety.  I don't know if the signs are enough to enforce the prosecution of a ticket for trespassing like on private land, but if there is a ordinance or statutorily backed rule by the commission then it could mean some expensive fish if you are ticketed for fishing there. Nothing in this opinion is meant to reflect the views of Ultimate Bass or their sponsors or meant to be legal advice, it is strictly for entertainment purposes..lol

BASS deemed the barge turnaround off limits for the 2009 Classic, per Louisiana law.  Based purely on property law, the private ownership of this turnaround is questionable, but, since it is a government entity running the port, all bets are off.  I would certainly stay clear.

I have been out there the last three evenings and people are parking their boats and barges out there and swimming at the mouth of the area.  wonder why they have not been ticketed?

Beagle

Don't know but I'm not fishing it.

under the new ruling of navigable waterways unless you can access the area when the water is at normal pool then the area is private. So technically the oxbow that brauer won the event in should be private property. I wouldn't be surprised to see this area posted if it becomes heavily used. Just because the water has flooded into your home doesn't mean its now public property its the same way with land. ~read

The barge turn around is accessable by a bass boat at normal pool but a barge can't.

Beagle

That might change. I was out their a couple of days ago and they are doing alot of work back their.
